Important Notice:

1.By accessing this official website [https://www.silkroadluxurytrains.com], submitting a booking, and completing payment, you acknowledge that you have fully read, understood, and agreed to the entirety of this User Agreement and Terms, the Refund and Cancellation Policy, the Service Delivery Policy, and the Privacy Policy. The above documents collectively form the complete travel service contractual relationship between you and us.

2.This Agreement has the same legal effect as the paper/electronic Travel Contract signed by both parties. In the event of any conflict between the terms of this Agreement and the signed Travel Contract, the signed Travel Contract shall prevail.

3.This Agreement also addresses the relevant compliance requirements under the Tourism Law and the Civil Code of the People's Republic of China, as well as the GDPR and CCPA-CPRA. All global visitors to this website are subject to this Agreement.

A.Definitions

1.We / Travel Agency: Guangdong Train of Glamour Tourism Co., Ltd., the operator of the Silk Road Express luxury tourist train.

2.User / Traveller / You: Any natural person who accesses the website, submits a booking, pays the travel fees, and participates in the Silk Road Express train tour services.

3.Train Tour Product: Refers to the package travel services of the Silk Road Express high-end tourist train, including on-board accommodation, on-board meals, ground tours as listed in the itinerary, tour guide services, and other bundled services, as detailed in the specific itinerary.

4.Itinerary: As an appendix to this Agreement, it sets out the departure/end time, stopover stations, sightseeing items, and included/excluded services, and has the same legal effect as this Agreement.

5.Performance Supporters: Third-party entities that assist us in actually providing the travel services, such as railway authorities, ground reception agents, hotels, scenic spots, and insurance institutions.

6.Force Majeure: Means unforeseeable, unavoidable, and insurmountable objective circumstances, including but not limited to: natural disasters, earthquakes, floods, typhoons, epidemics, government controls, border restrictions, national railway unified dispatching, track construction, train maintenance, and public emergencies.

7.No-Show: A confirmed booking where the traveller fails to arrive at the designated boarding location at the scheduled departure time on the day of departure without submitting a prior written cancellation request.

B.Bookings and Eligibility

1.When making a booking, the user shall ensure that all group members hold valid and lawful identification documents (ID card, passport, etc.), and that such documents remain valid for the entire itinerary. If boarding is denied due to expired or missing documents, or visa issues, the user shall bear all consequences, and the matter shall be handled in accordance with the Refund and Cancellation Policy.

2.The user is obligated to truthfully disclose the health conditions of all travellers, including but not limited to heart disease, hypertension, pregnancy, allergies, and chronic illnesses. We reserve the right to refuse bookings or boarding for individuals who are not suitable for long-distance train travel. If health conditions are concealed and personal injury occurs during the itinerary, the traveller shall bear all related liability and losses.

3.Minors must be accompanied by a guardian, who shall be fully responsible for the minor's safety throughout the trip. We reserve the right to refuse boarding for unaccompanied minors.

4.The itineraries, images, and promotional text displayed on the website are for reference only and do not constitute an offer. The final service content shall be based on the confirmed itinerary and the signed Travel Contract.

C.Payment

1.After a booking is submitted and the seat is confirmed, the user shall pay 30% of the total order amount within three (3) calendar days of the booking confirmation to secure the train compartment. If the required payment is not made in accordance with the contract, we reserve the right to release the seat and cancel the exclusive hold on the compartment.

2.The full payment must be settled no later than sixty (60) calendar days before the departure date. If the final balance is not paid by the due date, it will be deemed as a unilateral cancellation by the user, and charges will be applied in accordance with the Refund and Cancellation Policy, and the seat will be released.

3.All amounts are in CNY or USD. Payment methods include corporate bank transfers and online platform payments. The receiving entity must be Guangdong Train of Glamour Tourism Co., Ltd. Payments made to any individual account will not be recognised by us.

4.After the user completes payment, we will send a booking confirmation email within three (3) to five (5) working days. The user should review the order details and must notify us in writing of any errors within 48 hours; failure to do so will be deemed acceptance of the order details as correct.

D.Changes, Cancellations, and Refunds

1.All cancellation and change requests must be submitted in writing via email. Verbal or instant messaging notifications will not be deemed valid. The effective date of cancellation shall be the date on which we receive the written request by email.

2.The rules regarding rescheduling, cancellation charges due to personal reasons, cancellation due to failure of the travel agency to form a group, No-Show handling, and refunds in case of force majeure shall be strictly in accordance with the Refund and Cancellation Policy, which forms an integral part of this Agreement.

3.Refunds will be processed to the original payment account. The bank processing period is 7 to 14 working days. We will complete internal refund procedures within 5 working days of receiving a valid cancellation request.

E.Performance and Changes to Travel Services

1.We will provide the package travel services in accordance with the confirmed itinerary. In the event of force majeure, railway scheduling, government orders, or other reasons not attributable to us, we reserve the right to adjust the order of the itinerary or replace services with equivalent alternatives within a reasonable scope, and will notify the traveller promptly.

2.In the event of temporary railway schedule adjustments, train delays, changes in stopover stations, or temporary train re-formation, such events are inherent operational risks of the train tour. Neither party shall be held liable for breach of contract. We will make reasonable efforts to arrange alternative services and will only handle charges for services not actually provided in accordance with the applicable rules.

3.During the itinerary, if a traveller is stranded due to force majeure, the additional accommodation and meal costs shall be borne by the traveller; the additional return costs shall be shared between the travel agency and the traveller.

4.We do not guarantee zero train delays. Train schedules are subject to the actual dispatching of the railway group. Train delays do not by themselves constitute grounds for a refund.

5.Travellers may not unilaterally demand changes to services beyond the contract. Any additional requests, if agreed by us, shall be borne by the traveller at their own expense.

F.User’s Responsibilities and Obligations

1.Travellers shall comply with national laws and regulations, railway safety rules, and local customs of the destination. They shall not engage in illegal activities, gambling, excessive drinking, or any conduct that disrupts train order or group discipline. In such cases, we have the right to unilaterally terminate this Agreement, remove the traveller from the group, and not provide a refund. Any losses caused shall be compensated by the user.

2.Travellers shall take proper care of their personal luggage and valuables, and are advised to carry valuables with them. We shall not be liable for loss or damage to luggage or belongings, except in cases of our intentional misconduct or gross negligence.

3.During free time or self-arranged activity periods, the user is solely responsible for their own personal and property safety.

4.Travellers shall not leave the group without authorisation. If a temporary departure from the group is necessary, prior written notice must be given to the tour guide. Any unauthorised departure shall be at the traveller’s own risk and expense.

5.Users shall cooperate with safety briefings and emergency response measures, and follow the instructions of the tour guide and train staff in emergencies.

6.Travellers are encouraged to purchase their own personal travel accident insurance. We strongly recommend such purchase; if the traveller declines, they assume the related accident risks.

G.Our Responsibilities and Exemptions

1.We provide services in accordance with the law and this Agreement. If service defects arise due to the acts of performance supporters (railway, hotels, scenic spots, ground agents), we will assist the traveller in claiming against the third party, but such third party’s liability shall not be assumed by us.

2.The travel agency shall not be liable for breach of contract in the following circumstances:

- Force majeure events.

- Personal injury or property damage caused by the traveller’s own health conditions or personal negligence.

- Losses occurring during self-arranged activity periods.

- Third-party tortious acts.

- Events that cannot be avoided even after reasonable care has been exercised, such as public transport delays or temporary closure of scenic spots.

3.Our liability shall be limited to the scope provided in the travel contract and applicable law, and we shall not be liable for indirect losses or lost profits.

H.Website Terms of Use

1.Users may access and browse this website. All text, images, image materials, and the trademarks “丝路梦享号/Silk Road Express” are our intellectual property. Without prior written permission, reproduction, republication, commercial use, or secondary editing is prohibited.

2.Users shall not use the website for attacks, crawling, spam, fraudulent bookings, or other malicious activities. We reserve the right to block abnormal access.

3.All content on the website is provided for reference only and does not constitute professional travel or health advice.

I.Intellectual Property

The trademarks, logos, copy, photographic images, and designs related to the website and the train are the property of Guangdong Train of Glamour Tourism Co., Ltd. No institution or individual may reproduce, distribute, or use them for commercial purposes without prior written authorisation. Personal photos taken by travellers during the trip remain the copyright of the traveller. If we wish to use any traveller’s portrait for promotional purposes, separate written permission must be obtained from that traveller.

J.Dispute Resolution

1.Disputes between the user and us shall first be resolved through negotiation by email or customer service.

2.If negotiation fails, either party may bring an action before the competent court at the place where this Agreement was signed (Huangpu District, Shanghai). For overseas users, arbitration may be filed with the Shanghai International Economic and Trade Arbitration Commission (SHIAC).

3.For overseas users: Unless otherwise specifically agreed, this Agreement shall be governed by the laws of the People’s Republic of China, excluding its conflict of law rules.

K.Amendments to this Agreement

1.We reserve the right to adjust this User Agreement and Terms, the Refund and Cancellation Policy, the Service Delivery Policy, and the Privacy Policy. The new version will be posted on the official website with the date of adjust indicated at the top.

2.For confirmed orders, the version of this Agreement in effect at the time of booking shall apply. New access and new bookings will be subject to the adjustd version.

L.Entire Agreement

1.This User Agreement, the Refund and Cancellation Policy, the Service Delivery Policy, the Privacy Policy, the Itinerary, and the signed Travel Contract constitute the entire agreement between the parties, superseding all prior oral or written communications.

2.If any provision of this Agreement is held invalid by a competent authority, the remaining provisions shall continue to be valid and enforceable.
